Court for Conflicts of Jurisdiction - Composition

Pursuant to Article 38 of the Organic Law on the Judiciary, the Court for Conflicts of Jurisdiction is a collegiate body composed of the president of the Supreme Court, who chairs it, and by five members, two of whom will be Magistrate-Judges of the Chamber for Contentious Administrative Proceedings of the Supreme Court, appointed by the Plenary of the General Council of the Judiciary, and the other three will be permanent Counsellors of State. The Senior Court Registrar of the Supreme Court acts as registrar.

By a decision of 17 December 2025, the Plenary of the General Council of the Judiciary decided to appoint the Magistrate-Judges of the Third Chamber of the Supreme Court who were to form the Court for Conflicts of Jurisdiction during 2026 and ordered the publication of the appointments made by the Plenary of the Council of State with regard to the permanent counsellors who were also to form the Court of Jurisdiction in 2026 (BOE of 29 December 2025). 

Pursuant to this decision, in 2026 the Court for Conflicts of Jurisdiction is composed of the President of the Supreme Court, who chairs it, and the following members:

  • Permanent members:
    • Esperanza Córdoba Castroverde and Fernando Román García, Magistrate-Judges of the Third Chamber of the Supreme Court.
    • Enrique Alonso García, María Luisa Carcedo Roces and  Miguel Herrero y Rodríguez de Miñón, permanent Counsellors of State.
  • Alternate members:
    • Manuel Delgado-Iribarren García-Campero and María Alicia Millán Herrandis, Magistrate-Judges of the Third Chamber of the Supreme Court.
    • Magdalena Valerio Cordero and Paz Andrés Sáenz de Santa María, permanent Counsellors of State.
