How does the HCJ Region of Murcia work?

The high court of Region of Murcia is the maximum expression of the judiciary in the autonomous community. It was established 23 May 1989 as an integrative organ of the judicial framework. The high courts are the product of the plan envisaged in article 26 of substantive law of the judiciary. 

The Divisions which compose it are:

  • Civil and Criminal Division
  • Contentious - Administrative Division
  • Labour Division

Moreover, two divisions without any judicial functions are part of the High Court of Justice for the Region of Murcia, namely:

  • Government Division
  • Special Division


Civil and Criminal Division

The Chamber of Civil and Penal Matters is presided by the chairman the the Region of Murcia. There are also two other magistrates belonging to this Chamber, one of them appointed by the General Council of the Judiciary from a short list submitted by the Assembly of the Region of Murcica and made up of jurists of known prestige. After his or her appointment, the candidate becomes recognised – to all intents and purposes – as a member of the Legal Profession. At the present time, a third attached magistrate completes the Chamber.

In its quality of a Civil Law Division, it takes cognizance of:

  • appeals for cassation and extraordinary appeal for review against rulings of jurisdictional organs of the civil type based in the Autonomous Community, provided that the appeals is based on an infringement of the civil, regional or special law rules of the community, and when the relevant Autonomy Statute provides such assignation.
  • civil liability lawsuits, due to acts perpetrated during the exercise of the respective functions, filed against the President and Members of the Government Council of the Autonomous Community and against other members of the legislative Assembly, when such assignation does not correspond, pursuant to the Statute of Autonomy, to the Supreme Court
  • civil liability lawsuits, due to acts perpetrated during the exercise of functions, filed against some or most of the magistrates of the Provincial Court or of any of its sections
  • competence issues of the jurisdictional organs of the civil type based in the Region of Murcia, which do not have a higher common one
  • In its quality of a Criminal Law Division, it takes cognizance of:
  • the criminal cases which the Statute of Autonomy assigns for the High Court of Justice; investigating and ruling on criminal cases against Judges, Magistrates, and members of the Public Prosecutor's Office due to offences or misdemeanours perpetrated during the exercise of their functions in the Autonomous Community, unless this power is not assigned to the Supreme Court
  • appeals against first instance decisions issued by Provincial Courts, as well as those stipulated by the laws in force
  • competence issues among jurisdictional organs of the criminal type based in the Region of Murcia, which do not have a higher common one

Contentious-Administrative Division

It is composed of 7 magistrates, presided by the magistrate Abel Ángel Sáez Domenech, divided into two sections.

It takes cognisance of:

  • appeals filed in connection to acts of the local Institutions and the Administrations of the Autonomous Communities, whose competence is not assigned to the Contentious-Administrative Courts
  • appeals filed against decisions and rulings issued by the Contentious-Administrative Courts and the relevant motions for reconsideration of dismissal of appeal
  • appeals for review against judgments issued by the Contentious-Administrative Courts
  • competence issues among Contentious-Administrative Courts with based in the Autonomous Community
  • appeals for cassation for the unification of the doctrine or the interest of the Law in the cases stipulated in the Act on the Contentious-Administrative Jurisdiction

Labour Division

It is composed of 5 magistrates, presided by the magistrate Rubén Antonio Jiménez Fernández.

It takes cognisance of:

  • the proceedings determined by the Law, which affect the interests of workers and employers in a higher level than the labour court and lesser than that of the Autonomous Community
  • the appeals which the Law determines, against decisions delivered by the Labour Court of the Autonomous Community
  • the appeals for reversal and any such appeals as may be stipulated by the Law, against the decrees of the Commercial Courts of the Autonomous Community in labour matters and which resolve on bankruptcy incidents which have the same subject matter 
  • competence issues which arise among labour courts of the Autonomous Communities

Sala de Gobierno

It is the highest internal government organ of the courts and tribunals of the Region of Murcia

It is composed of the president of the High Court of Justice, who presides this organ, the Presidents of the Divisions of the High Court of Justice for the Region of Murcia, the President of the Provincial Court, and by an equal number of Magistrates and Judges elected by the members of the judicial career who serve in the Autonomous Community. The Secretary of the Government of the High Court of Justice for the Region of Murcia is also part of this Division.

Special Division

It takes cognizance of the challenges filed against the President, the Presidents of Divisions or of Provincial Courts. It is composed of the President of the High Court of Justice, the Presidents of the Divisions and the most modern Magistrate of each division.
