On 22 July 2016 new regulations came into effect on the contentious administrative cassation appeal, introduced into Law 29/98 regulating contentious administrative jurisdiction by Organic Law 7/2015. It will apply to judgments and rulings subject to cassation appeal dated from 22 July 2016 onwards (decision of the admissions section of 22 July 2016)

The new regulation on cassation appeal constitutes a structural change in configuration, as the legislator has introduced the objective cassation interest for the formation of case law as a criterion for deciding on admission of the appeal. Cassation appeals for the unification of doctrine and on a point of law cease to exist and the limitations on amount and area that existed thus far in relation to judgments and rulings of the Chamber for Contentious Administrative Proceedings of the National High Court and High Courts of Justice are removed, extending appeal to certain judgments of the Courts for Contentious Administrative Proceedings.

To address this reform, the rules on distribution and composition for Chamber 3 of the Supreme Court have been modified and other non-jurisdictional decisions have been issued to establish criteria regarding the extrinsic formalities of pleadings and other relevant issues in reference to its entry into effect.

The list of cassation appeals that are admitted for hearing will be published via this channel, as established by Article 90.7 of Law 29/98. They may also be found using the CENDOJ (Judicial Documentation Centre) case law search engine.
