Ordinary Chambers -Second chamber - Duties

The Criminal Law Chamber of the Supreme Court shall hear (Art. 57 of the LOPJ):

1st The appeals, reviews and other extraordinary Criminal Law matters established by the Law.

2nd The investigation and prosecution of causes against the Prime Minister, the Presidents of the Congress and the Senate, the Chief Justice of the Supreme Court and Chairman of the General Council of Judicial Power, the Chairman of the Constitutional Court, members of the Government, Representatives and Senators, members of the General Council on Judicial Power, Judges of the Constitutional Court and the Supreme Court, Chairmen of the National Criminal Court and any of its Chambers and the High Courts of Justice, the Attorney General, Prosecutors of the Chambers of the Supreme Court, the Chairman and Trustees of the Court of Auditors, the Chairman and Trustees of the State Council, the Public Defender’s Office and the President and Councillors of an Autonomous Community, when so determined by the Statute of Autonomy.

3rd The investigation and prosecution of causes against Judges of the National Criminal Court or a High Court of Justice.

4th Of the other matters that this Law attributes to it.

5th. For autonomous confiscation procedures for crimes they are responsible for hearing (subparagraph 5 is added to paragraph 1 of final provision 1.1 of the Organic Law 13/2015 of 5 October. In force as of 06/12/2015).

In the cases referred to in the second and third sections of the preceding paragraph, an investigator shall be appointed from among the members of the Chamber, in accordance with an established rotation schedule, who shall not form part of the Chamber, to prosecute them.

In addition to the powers attributed to the Civil and Criminal Chambers of the Supreme Court in articles 56 and 57, said Chambers will have knowledge of the processing and development of the civil and criminal proceedings, respectively, against the Queen consort or the consort of the Queen, the Princess or Prince of Asturias and his consort, and against the abdicated King or Queen and their consort.
