What is the Supreme Court?

The Supreme Court is based in Madrid and is the sole judiciary body in Spain with jurisdiction throughout the nation, being the highest court in all legal fields (Civil, Criminal, Contentious-Administrative and Labour), except as provided with regards to issues of constitutional guarantees and rights, the competence for which resides with the Constitutional Court. It was created in 1812 by the Cádiz Cortes (Decree of the Parliament of 17 April 1812) to exercise the powers established in Article 261 of the Constitution of Cádiz.

Specifically, the Supreme Court is the pinnacle of the appeals system and is therefore ultimately responsible for the uniform interpretation of jurisprudence in Spain. It takes care, inter alia, of judging appeals for reversal, reviews and other extraordinary cases, as well as the prosecution of members of upper institutions of the State and the processes for declaring political parties to be illegal.
