Judicial disciplinary system

The Council is the body responsible to apply the disciplinary rules that regulate the non-fulfilment of the professional responsibilities of a judge, relative to both the professional practice and the relationship with citizens and professionals of the Justice Administration in Spain.

The practice of the functions of a judge relates to, in general terms, the following ten principles:

  • Independence.
  • Impartiality.
  • Subjugation to the law.
  • Integrity and honesty.
  • Spirit of service and adequate treatment with workmates, professionals and citizens.
  • Respect to the parties intervening in the process.
  • Subjugation to the corresponding process.
  • Lawsuit resolution within a reasonable deadline, according to the circumstances in each case.
  • Motivation of the judicial resolutions.
  • Obligation to keep the professional confidentiality.

The General Council of the Judiciary has the jurisdiction to demand disciplinary responsibility from Judges. Through  the commencement of a disciplinary file with the aim of establishing the scope of the conduct carrid out by the judge, the Council resolves the existence of an infringement and the imposition of the appropriate sanction.
