Mediation

Introduction

The Plan of Modernisation of Justice, approved for a new period by the Plenary Session of the General Council of the Judiciary, includes a specific reference for civil and criminal mediation as an efficient tool for the resolution of conflicts. A set of statutory and procedural reforms are framed within this focus, with the aim to boost quicker Justice solutions.

The civil mediation, used mainly within the family scope, can also be successfully applied to disagreements on contracts, mercantile relationships, in the scope of consume or horizontal property.

In criminal mediation, by means of a process of dialogue and confidential communication, conducted and directed by an impartial mediator, victim and perpetrator admit their capacity to solve the conflict originated by the crime.

The possibility to try different mediation experiences and methods in some processes of the administrative-litigious jurisdiction should also be tackled, pursuant to article 77 of the Law ruling this jurisdiction.

We also want to offer this Web as a space to exchange experiences and circulate any activities, events and information that can contribute to improve the efficacy of those working in mediation projects.

I invite you to learn more and take active participation in this project, in my role of Delegated Member for the Coordination and Promotion of the Civil and Criminal Mediation Project, with the technical support of the Service of Planning and Analysis of the Judicial Activities.

Margarita Uría Etxebarria

Delegated Member for the Coordination and Promotion of the Civil and Criminal Mediation Project coordinated by the General Council of the Judiciary.
